This comprehensive online discussion explores various facets of copyright law, with a focus on Romanian legislation and its international implications, for an audience of practitioners in the cultural and creative areas. The topics range from general concepts in digital copyright to specific aspects of Romanian law.

Participants will delve into the definitions and implications of “out-of-commerce works” as per the 2019 EU Copyright Directive, orphan works, and the copyright status of digitized cultural heritage.

The discussion will clarify the distinctions between public domain, open access, and open source concepts.

A significant portion will be dedicated to Romanian copyright law, covering authorship definitions, protection durations, and the international scope of copyright protection for Romanian authors. The role of Collective Management Organizations (CMOs) in Romania and their international collaborations will be examined. Special attention will be given to regulations governing the temporary export of significant Romanian artworks classified as “Fond” or “Tezaur” for international exhibitions.

The evaluation process for public domain artworks by Romanian citizens, both domestically and internationally, will be discussed, along with legal considerations for creating derivative works based on public domain pieces by Romanian artists.

The session will conclude with an exploration of copyright management for collective and derivative works, providing a comprehensive overview of copyright issues in the digital age, with a specific Romanian perspective.
